As well as you're actions so far - Just ask them to return the money or we'll arrange for every car forum to go after them starting here.
A nice Twitter storm might also focus their minds a little. It will be a little unwise for them to try and withstand a concerted barrage against them. It will quickly escalate beyond their capability to manage it. Far more cost effective to pay up quietly and do it now. Tell them you'll create hell and we have the numbers to cause them pain.

Use as many angles as possible including posting questions for advice on other websites eg magazines....etc.
Look at other possibilities like BBC Watchdog too.
Post on the dark-side too :whistle:

We can quickly undo any good name that they seem to present themselves with.
Best to have it planned so it can be unleashed quickly if they call your bluff. Their risk.

Our Gary bought this from a dealer down in Peterborough week before last. He has had some paintwork done and generally it's good car.
However I would put off by the fact he just started to "wash" it as we pulled into his forecourt. The other cars there do not bear any resembelence to the ones on his eBay page, to give the guy the benefit of the doubt I would say he's trying to do too much on his own without help. The office was a s*** tip, with stuff all over the place.
Last Sunday Gary and Isabelle came over and we set to and gave it a good clean which it should've had before we went to collect it.

A guy I work with also does deniable ops for HMG (and other governments). He and his mates could sort it from over a mile away. How big a pile of sawdust and metal shavings would you like afterwards? :whistle:=))

I knew that's what had happened with Moz, bless him, after all he's over there up in them there mountains and sleeping outside on wooden benches and logs, he must have got stiff little fingers with all the frost.!! :whistle:

I'm not sure many dealers actually care, I think it's only a small percentage of buyers who actually roam the forums.

They've got a big turnover so I guess they'll just rely on a large selection of cars, and new customers.

It's after sales service that really counts, in our OP's case they are with holding a payment because he failed to turn up to see the car he paid to hold.

Their only mistake really is not explaining that the payment was non refundable if he didn't make the journey.

In this case they should refund it, but I'm not sure it warrants a war against them on the internet.

I know I'm going against the grain of the thread here, but please remember, unless you've had personal dealings with them yourself you may be open to a slander case against you if J17 start to take an interest in the slammings on the internet against them.

Thought I'd say that even though I know some of you will disagree, but is it really fair to heckle them if you've not had dealings yourself?

Having good knowledge of the industry it is in general a poor one to be in and that's why I turned my back on it, These guys are just down right Dick Turpins. I really cant see them pursuing anything as they are very well documented and I think they would be laughed at at the first hurdle. I see what your saying though Tim but maybe it's a little bit of reap what you sow.

But I thought I'd better point out the legal stuff, slander is an easy one to prove, and no defence in court if the accused has not actually had any dealings with the company.

And to the OP, how did you get on with the bank?

It really is a simple one, if they didn't make it clear the "holding fee" will be non refundable if you didn't show, then you should be able to do a chargeback and get your money back instantly while they await J17's response.

Nobody has been slandered.

We're pointing out that what is seemingly sharp practice against one of our own won't go without comment.
If they have acted illegally then they are fair game. What I am saying is that corralled resources on the internet is a powerful tool to bring that behaviour to wider attention. It's normally a great tool to apply pressure to organisations too.

The cost of making the issue go away is a very small one. Even a 50/50 split I suspect would be acceptable. If they failed to make clear it isn't returnable could be a simple mistake.
They clearly have it seems a significant reputation. They appear to have no good-will. That is what this is about.
This simply reinforces what I and many others think. Others may not have a view. You choose.

Hi Tim, your comments are welcome too that's what its all about. To go back to the beginning of my telephone conversation with them to a guy named Jay at the Nottingham showroom he confirmed that the "holding fee" (Not a deposit) was fully refundable under any circumstances! I understood it that the car would just have a reserved sign on it until I got there. I would have thought that had I been able to make the trip and use their fuel on a test drive and then take some ones time talking it over and then didn't buy that would have been a cost to them! As it turned out it hasn't cost them anything.
And lets be honest doing what they have done to a potential customer is not the way of a reputable dealership, and then not to have any response from them just aggravates the situation unnecessarily don't you think?
The bank by the way are sending me the relevant paperwork out, I will probably get them by Tuesday, shouldn't be a problem I hope, It will
take about two weeks after I submit them for an answer I believe.:thumbsup:

You have nothing to worry about, you'll get it refunded.

My Local Trading standards office rang me yesterday to say that their Nottingham branch had contacted them about my issue with junction 17 and said that they have an interest in them, but cant divulge anything about what it is as they must stay impartial. They asked if I had heard back from junction17 about my latest email giving them 7 days to respond, which will be up next Monday, but i'v had no reply again so they now intend to send them a formal letter on my behalf next Monday!
The Nottingham standards office are looking into their trading practices as well.

That's very true mate, but these type of "Dealers" know the loop holes and usually fly very close to the wind keeping just on or inside the law. Don't forget they make a "living" ripping people off, they know what they're doing all right.

Only this morning I had a phone call from trading standards asking me if I had heard anything from junction 17 as they too had written to them last week and had given them 7 days to respond but I said i hadn't had any contact from them.

Tonight Just checked my bank account and hey presto they have refunded the holding fee!
I hope I have been a right pain in the ar** to them, not only over the holding fee alone but because after reading reviews this seems to be their normal practice. I don't doubt though that they will still do same to others!

I have also noticed tonight that only now have they removed that BMW 135 cabriolet that I first contacted them about, has been removed from their advertisements months after they told me that it had been sold early June. I think the Nottingham trading standards office seen to that part of my complaint.
So, needless to say I wont be talking to them ever again about any car!:) BE WARNED!!:nailbiting:

A bit of good news ! I am pleased for you and let's hope that trading standards can do something about these cowboys. I will certainly steer clear of Junction 17 cars.
