Most likely in the same position as if you hit any other road user, be it cyclist, pedestrian or vehicle. It will be investigated and if you're found to have been negligent in any way, you would face the consequences.
Up in Glasgow the delivery cyclists are now using the M ways Tony. To be fair, some of them are going pretty quick.
The student areas are polluted with electric scooters and boards. Unlike above though Tony, they don't wear hi vis. Or lights. I came seriously close to mowing down a young woman before Christmas, who drove straight off a pavement and went the wrong way round a roundabout, giving me an evil look to say I was in the wrong.
Not long ago I saw a cyclist write a car off, came screaming round a corner, easy 25mph, coffee in one hand, just as a guy opened the door of his car. He had looked, I saw him. She took the door out of his hand, somersaulted over the top, landed straight on her arse, STILL holding the bloody coffee! Guy helps her up and she's off, carrying the bike with a mangled wheel, coffee still in hand. He asks a buystander , obviously as a witness, just in case, quick discussion, goes to get back in the car and the door won't shut. Not at all. Even from 50 yards and 2 floors up, I can see it doesn't fit in the frame, not even close. Guy looks up the street, girl is long gone, car eventually leaves on a tow truck.
Hang not so fast! (no pun intended) For now, the area is unofficially grey, with no specific legislation for electric skateboards. Hoverboards, Onewheels and Electric Scooters are all banned in public places but as of yet, Electric skateboards remain unlegislated.
Will I have to wear a helmet and high vis.
As there is no specific legislation, they still fall into the classification of mechanically propelled vehicles under the Road Traffic Act. So, they require licence, insurance etc.
Funny we’re on this, walking to the car tonight two young women grabbed their phones and pointed them vaguely behind me. Turned to see a Deliveroo guy pedalling furiously down the cycle lane, head down, texting away with both hands.

The problem lays in their description and legal status. They are not yet defined as powered transporters but pleasure devices and fall outside the current legislation, as you can see similar types of powered transporter are mentioned there, so enforcement can be enacted. You can't just lump something new into old legislation because it fits, once their purpose is designated & they are included in S2 --- then bingo, if a user went to court the Judge would throw it out. Why do you think the other types of mobile pleasure devices were re-designated??
That's exactly how it happens. Something new comes along and there isn't specific legislation for it. It therefore gets fitted into existing legislation which may not be appropriate until it generally becomes enough of an issue that specific legislation is introduced.
It’s UP off the road, if a sheep farmer can herd his sheep with one what’s to say I can’t go to my local shops using one.
