The whole story shows how stupidly pc we all have become.
Its totally absurd that the court case was even started .
Just shows how a idea full of good intentions can go badly wrong.

It's a disgrace. Though nothing to do with PC I would imagine. Just publicity seeking.

The photographer is a good guy who deserves the credit. Not least as he was promoting the welfare of the monkeys initially. PETA are just promoting themselves.
 
He can charge the monkey a fee for access to and use of the camera with a clause for reproduction fees for subsequent image use. Also agent fees for handling the publicity.
Then on behalf of the monkey he can sue for all the unauthorised use of the image and take his cut. Am sure the monkey will readily agree even retrospectively. :D
