It wasn’t malicious! How can the driver be responsible for the state of the road? It was a deep pothole. The guy pulled left because of the central island ahead just before a junction on the right that is notorious for people pulling out.

The guy was just in the wrong place at the wrong time.
 
As you were there, then obviously you are in a better position to say whether it was done maliciously or not.

However my view from the video was there was enough room for him to have avoided the puddle.

Malicious or not it's not the best driving. Never drive through a roadside puddle if you have room to miss it, which the driver did, as you never know how deep it is and you could damage your car. Basics.
 
I'd agree, he swerved to the puddle - so it looks, leaving plenty of room to the right clearing the island - well before the junction you mention.

Loads of room to miss the puddle before the island, if he needs to hug the curb to miss that island I suggest he learns the width of his vehicle, or swop it for a narrower one.
 
IMO the driver definitely hits the puddle on purpose and it was a deliberate act
 
What’s wrong with forward observation ie, roadside puddle of water verses pedestrian, brake or change position so as to avoid avalanche of dirty water. Lack of hazard awareness.( Not rocket science.) You’ve got it on camera, maybe the innocent pedestrian would’ve liked an offer of the use.

I would say the driver could've avoided drenching the guy on the path and if not on purpose he was fairly negligent . I think it is something you can be charged for?

Sorry guys. You’re wrong. It was unfortunate not deliberate. I’m not going to get someone in to trouble. Video will be removed.
