If it is not Illegal to eat or smoke then i can not see how they can implement the fine, i would imagine all the fines will be contested costing us the tax payer loads in unnecessary court cases

Ref the eating and drinking apparently if the police feel that it is interfering with your control of the vehicle then you 'could' be charged with driving without due care and attention.

Makes yo wanna weep doesn't it.

When my daughter first started driving, she got pulled over by the police, she was eating a sausage roll at the time , she threw it over the back seat , when the policeman got to her window he said do you know your got a light , she thought he was going to say she couldn't eat whilst driving =))
 
When I worked for Virgin media one of our lads got fined for eating a banana whilst driving his work van, the policeman pointed out that it takes 2 hands to peel a banana

I'd argue against that policeman's point. Hold the banana and peel it with your teeth.
One of our former neighbours was born with one arm and doesn't always wear his prosthetic, and you should see the things he does. He played darts in our pub league and would throw his dart while holding the other two in the same hand.

The law has always been that if it affects your driving ability then "due care and attention"

Not sure how a fixed camera will determine that?

Why are these coffee chains putting drive throughs up on a lot of motorway services areas then? Surely that should be made illegal as they are encouraging drivers to purchase hot drinks whilst on the go or are they only allowed to buy for their passengers!
 
I was always led to believe that as long as you could do it single handed going in a straight line, not affecting your driving, it's ok.

On a roundabout however, if it was deemed to be affecting your driving, an officer could prosecute.

It's down to the officers really, if they think it's affecting your driving then they'll prosecute.

Then it'd be up to the court to decide I guess.

My training is well out of date now though.
 
If I'm honest I think Plod has better things to do unless they see it as outright dangerous.
