Fair or unjust

Maybe the Magistrate was a member of Cycling UK, which wants any bicycle/car collision to be judged to be the fault of the driver.
Yes, the driver should have slowed down or stopped, which would have been the polite thing to do, but I feel the judgement and verdict left plenty of room for an appeal.

I live in an area of France where we get loads of cycling Dutch people, who are supposed to have cycling in their blood. I have spent many afternoons outside the bistro watching cyclists ride past a clearly signposted no-entry sign, often cutting the blind corner, oblivious of any car which may be travelling towards them in the correct direction. A lot of them even have small children on handlebar seats - no wonder I mistrust cyclists on principle!

Another favourite stunt is for a group to ride in a line, leaving no space for overtaking, and so tempting the more impatient drivers to attemp an overtake in one mammoth move - even when approaching a blind bend . . . I often wonder if they think that the rules of the road, common sense, or self-preservation do not apply to them! Perhaps they have a death wish.

I sometimes even find cyclists riding through my garden as a short cut back to the road, because they are too lazy to retrace their path along the river bank. Their usual excuse is 'Oh, I did not know it was your garden.' Perhaps they are blind and stupid as well as ill-mannered.

The sooner cyclists have to pass a test, and carry registration plates the better - perhaps they would then accquire a sense of responsibility.
 
In the last 24 hours two drivers have driven straight out of side roads in front of my car causing me to make emergency stops. Do I think all drivers are bad? Of course not, so why are some drivers convinced that all cyclists are such a nuisance? I've been driving for over 50 years and I have no problem with the vast majority of cyclists. I have NEVER been significantly held up by cyclists. Either I'm amazingly lucky or more likely not so completely prejudiced with regard to cyclists. Perhaps it's because I'm also a cyclist and I know that a bad driver is far far more dangerous than a stupid cyclist.
 
The Landy driver was going a bit fast TBF, should've slowed. That said, I love the drama and the woman capsizing =))

I used to drive through London at least 2 days a week, seen many many cyclist mount busy pavements, ignore red lights, use zebra crossings at speed etc. etc. I have to disagree I'm sorry but a stupid cyclist can severely injure others and themselves and cause serious accidents, I have witnessed it. I also travel the Wye Valley regularly and have come across some shocking cyclist groups. But as a cyclist I agree not all are bad, many are not, the problem is a lot think they automatically have the right of way to the point of stupidity, road laws don't apply to them, don't use common sense and all other road users are always in the wrong.

It also amazes me how some seem to think they are invincible, now there's stupidity.
 
Yes he was going a bit fast but a harsh penalty for blowing a cyclist over with the draught from his Landy ;).

To my mind, anything on the road that is capable of exceeding 15mph and may cause injuries in the event of a collision should be taxed, insured, have a yearly safety check, registered, carry number plates and the rider/driver should have passed a test and be licensed.
 
All users of the highways and byways have a duty to care for other road users, hence my belief this was a 50 - 50 incident as most are.
When I first started driving lessons, my Instructor, one Derek Saundby told me to treat every other driver (road user) as an idiot and that has stood me in good stead for almost 50 years. An idiot in a black VW ( no, she’s in Florida =))) almost pulled out on me at our local idiotic junction but I anticipated that it would happen and avoided an accident.

It can never be 50 50 as one is in a car and the other is on a bike,as a result however unfair you think it may be the responsibility is on the car driver, it could of been someone learning on a bike looking for a quiet road or some kids on a bikes like we used to go. The roads are for all of us to use

I agree in this scenario as the Landy driver should've slowed down in anticipation of a possible event (the cyclist will always come worse off).
 
Would've scarred him, or her, for life I would think.;)
