Hi all,

What do you reckon my chances of appealing this Penalty Charge Notice are? I just filled out the online form and told them I was submitting their own PCN as all the evidence they needed....

I would have to say based on the evidence submitted in black and white you have every chance of winning as it clearly says the pay and display expired time is 50 minutes after the observation time ( bo bo by the warden I take it )

Stephen.

I've had a few PCN's and I've ignored every one of them. Some have sent follow up letters but I just ignored them too. I the end they stopped writing to me. PCN's are not enforcable. They have to take you through the small claims court and I guess I may have been lucky that they lost interest. In my defence in each of my cases I overstayed in the car park by a few minutes so may be they thought it wasn't worth the risk of taking me to court. Your choice though Gaz whether or not you want to take the same chances that I did

I don't think it was the wardens finest work, or they needed to get their quota right up at the end of the week. I was back at the car and left 25 minutes before the ticket was due as well, can back that up with a receipt from a drive through recorded at 14:40. Also just for extra annoyance, the ticket was stuck to the passenger side of the screen tucked down in the scuttle so you could just about see something from the drivers seat. I didn't see it until I was 5 mins down the road and had to pull over to see what it was. Idiots.

I was being sarcastic about this, they clearly shouldn't have issued it as the ticket hadn't expired. The PCN clearly backs up my argument that it shouldn't be issued!

I'd go with an invoice for an administration charge (£50) for handling the issue which is doubled if not paid within 28 days. If that isn't paid then County court for frivolous and vexatious summons or report it as fraud and seek costs for the stress and anxiety caused by their error by the incompetent operator.=))

Pity you didn't take a photo of the parking ticket and the charge ticket on your car.

I don’t believe a court case can claim for stress and anxiety as there is no monetary value placed on either.

I didn't fully read you post mate, I saw PCN and went off on one

On principle I’d appeal. Some years ago I parked up my sister’s car at hospital to drop my mother for treatment. I keyed in the registration but got one letter wrong. A photo came through from parking agency for £60 fine. I sent in an appeal pointing out my mistake and the fact that the photo showed the correct registration. I said if they checked their records the parking fee had been paid for the car in the photo just the registration was wrong.
Appeal upheld.
👍👍👍

They usually take a photo of the “offending vehicle” which should clear things up fairly categorically. You’ll have to request a copy of any photographs (if they exist) though, I doubt they’ll be offering them to you.

Well done.
They didn't have any option really just as in my case with my sister's car, I'd never NOT paid to park the car just a slip up with the number which I admitted.

If only the employed people who can read a 24 hour clock....
Just wondering a little further - the name of the location on the penalty notice doesn't match that on the parking ticket. Does that make every ticket they have issued there invalid?

While locals may know them as the same place visitors from other places may not.

2nd para doesn't make any sense, if he did photograph your car after the expiry of the ticket then the fine would be held up.

The offence didn’t take place where they claimed it to be. It isn’t that it didn’t take place but the paperwork isn’t valid so cannot be implemented.
