I know and it's not fair. Nothing will change unless someone dies. It needn't be that way.

1 as long as you have proof you reported it to your Manager
2 he the Manager has proof he told the owner
3 telling him its my duty of care to report this to the DVLA
the car being unfit for road use & must be transported off the premises or repaired
4 the dealer who sold it him in that condition should have had it removed
that would be my way of thinking

Shame the car didn't go to trading standards so the dealer could be prosecuted.

Not sure it was a dealer as such - just someone flogging cars 'sold-as-seen' probably.

First test on Monday morning was a 08 reg. Fiat Grande Punto, now I quite like the Punto in general, good little car, but this one ..........................
Having got under the car on the ramp it looked very "rusty" which is unusual these days. The bottom of the front subframe just didn't look "right" and after a couple of taps with the plastic hammer chunks of it started to fall off, leaving gaping holes right next to the lower arm mounting points:(. Next I started on the lower suspension arms and this happened,

Notice how close that is to the rivets which hold the bottom ball joint to the arm itself in the 2nd. picture.
On the O/S one it gets better,

When I had finished I told my manager to stress to the owner that this car was VERY dangerous to drive on the road, he said he would inform the customer and that is the total of my involvement in the job. The car was left in our yard overnight into Tuesday, I noticed I had gone midway through the afternoon and I asked what had transpired today. Manager said he told the man it was unfit and very dangerous to use and that the bill would around £600 to repair it. I'll scrap it then said the owner, only to come back yesterday stating he had contacted the man he bought the car from who said he didn't realise the condition of the car and would take it back against another car. The owner then left, in the Punto, heading back to seller's pitch to get another car,......................... in LEEDS FFS!!!!!! :rage:

MOT centres should have the power to seize any cars that are dangerous and the information passed to the relevant authorities. IMO

They are the experts on the ground. Use their skills. Trust their judgement. Have a recourse to a formal dispute scheme.
The downside is it's likely to lead to even more not presenting and/or driving without an MOT.
While there's no excuse, we all sometimes forget the MOT date. Would be helpful if you could set up a reminder on the DVLA website. Anyone then driving without an MOT still has their car seized if it's on the road.

Police reg. recognition cameras will flag if a car is tested or not along with road tax.

Works over here, you get a letter two months before MOT due date.
Our company sends out reminders a month before due to last years customers as do most businesses these days.
I would say that more than half the vehicles I've tested this week had an expired certificate and only came to light because the vehicle needed taxing!

Over here your safety is good for as long as you own the car but if you sell it within two years the new owner doesn't have to have it redone but if it's past two years most people safety it before advertising it for sale! JIM

Whenever I buy a car I always run the numberplate through the MOT history check. It shows up things like suspension corrossion. In the case of the Fiat I suspect that had been an advisory for a few years before.

Here in France, a new car gets its 1st Mot when it's 4 years old, after that it's every 2 years, and if it does fail, you get a month to fix it. Rather bizarrely motor bikes don't ever have to have a Mot.
