I would replace it like for like to be honest then you won't get any kinks in it. But are you sure that is where you are losing water from? I can't see any stain from anti-freeze on the picture of the pipe you posted.

Ok took all of the bits off the front and found its leaking from underneath, looks like the water pump as there is a noticeable grinding noise coming from around there. Also the fan is still not kicking in

Water pump and T/stat would be my first jobs in that case, get a water pump with a metal impeller though, not plastic.

ps. I think that pipe is probably a breather for the engine.

it would be easy just to go to your local bmw dealers with the car, they will get you the right part, unless someone as a second had one thats were you will end up any way,

The split pipe is a vacuum pipe quite reasonably priced from the dealer, their are two types so just give them your vin number, it will cause rough idle, but you can tape it up while you wait for the replacement.
