Advice anyone none Z3

Decided to purchase a new daily driver so went to Hyundai Dealer about 100miles from my house to look a Tucson Diesel liked the car did the deal and car was delivered on the 15th Jan . didn't use the car really very much until the following Sunday when i went to my parents house who live on a hill , any way handbrake would not hold and car started to roll down the hill , phoned the supplying dealer the following monday and asked the salesman what i should do they advised me to book it in to my local Hyundai main dealer which is 2 miles from my house and give them the supplying dealers phone number and they would lock after it (the car came with a 12months insurance backed warranty ) , the car went in last tuesday to my local dealer who said upon inspection it needed new back brake discs . brake pads and handbrake shoes
a total of £430 , they said the work wasn't covered by the warranty and the garage i bought it off said they wouldn't pay for it as there was nothing wrong with it when it was supplied by them even though the Handbrake wouldn't hold the car within 3 days of me buying it
i have the old discs pads and shoes in my garage and they are all worn the handbrake shoes completely worn out
Any one know were i stand with this ?
any help appreciated

Sorry to hear this.
I am afraid that even bumper to bumper warranty does not cover tyres, brakes, pads, clutch and battery.
When was the last MOT and who did it?

I would be going back to the dealer you bought it from and quoting the 'fit for purpose' rights.
OK, no warranty will cover consumables like pads, shoes and discs, but you have a legal right to
A) receive a vehicle in a roadworthy condition, which it wasn't as the handbrake shoes were shot.
B) the car must be 'fit for purpose' which includes serviceable brake parts.

It isn't a third party warranty issue, it falls into the legal obligations of the dealer you bought it from. As long as you can prove you haven't done excessive mileage in the car since you bought it, they have no leg to stand on (and they know it but just trying to fob you off).

I am presuming you paid the bill and are now looking for recompense? That is going to make it more difficult IMO. I wouldn't have paid the bill until I had come to a cast-iron agreement with the supplying dealer who was liable for the cost.

There’s your backup, shouldn’t have passed the health check. As dealer who repaired if they’d have let that go out the door like that after health check, then back to supplying dealer.Give them your points then tell them next call to Trading Standards. You’re not arguing about whether the warranty covers or not, car shouldn’t have been supplied like that.

Funnily enough I had a similar situation years ago, with a Hyundai!! Did the above and got a “goodwill gesture” (full amount) but no liability admission

Thank you you have just confirmed what i already thought ,i have paid my local dealer to do the work and just need to get the money back , i have sent the supplying Hyundai dealer the health report from my local Hyundai dealer along with email copies of the invoice and photographs of the worn parts and they say they will ring me back but havent yet but they say that every time i ring them which at least once a day , mileage wise it has done 92 miles by there delivery driver and approx 50 miles in the 3 weeks i have had it

The 92 miles is down to them. The 50 miles is the important one.
I would think you will get what you want, as you have a health check from the supplying dealer before you bought the car, which is obviously total rubbish.
As said by Andy above, I would be threatening them with trading standards aswell. They have sold you a potentially dangerous car but have ignored this on their paperwork.
As far as being fobbed off on the phone....stick at it. I would also email them (the dealer principal if you can get the email address) logging down the amount of times you have tried to get this rectified without response.

Did you use a credit card for any part of the purchase price (even a very small amount)?

If so you MAY have some recompense via your credit card company under the Consumer Credit Act. Worth googling up on it…

Yep. Vehicle warranty has limitations. But consumer rights act trumps that warranty.

You buy something from a business then the item must be fit for purpose. Sounds to me like it aint fit for purpose of you can park it safely.

I had a similar thing many years ago. Bought a VW from a dealer 10 miles away. Shortly afterwards it developed a clutch problem and I took it to the dealer at the end of my road. They advised me to take it back to the dealer I got it from because to inspect the clutch would involve work that might not have been covered by the warranty, whereas the supplying dealer would be obliged to just sort it out. In the end, the supplying dealer did sort it for free. I think the issue is that not all dealers are owned by the same companies, so they are not obliged to help each other just because they sell the same cars.

I think you will have them in your pocket if you take it further and would do so on Tuesday if the dealer can’t be arsed to do the right thing here, as what the others have said above, you have them by the short and curlys with that health report. Makes me mad that a dealership thinks they can fob you off like that.

Hi everybody thank you for all your help , Just an update, got an email from manager of the dealership asking for my bank details as they were doing me a full refund for all the brake work ,
Good news. But while they are on the back foot, I would ask them why they provided a fraudulent health check and how much your silence is worth?

And also how much of the rest of the Health Check, which you based your purchase on, is as accurate as the brakes section 🤔
